New obligations in Austria - the authorised representative

Foreign companies that place their packaged products and packaging of certain single-use plastic products on the market in Austria are obliged to appoint a so-called authorised representative as of January 2023.   

This authorised representative assumes all packaging law obligations on behalf of the principal and is also responsible for compliance with the Austrian administrative regulations.

Am I affected by this obligation?

The obligation to appoint an authorised representative applies to mail order companies that place packaging on the market in Austria from abroad to private consumers, as well as to foreign distance sellers of disposable plastic products (such as wet wipes, balloons, tobacco products, etc.). The obligation applies regardless of the registered office of the foreign company, i.e. with its registered office in EU countries or in third countries.

 

If you supply other than private consumers from outside Austria, you MAY still be subject to an obligation. This must be checked in each individual case.
